IN THE HIGH COURT OF DELHI AT NEW DELHI
Tushar Rao Gedela, J
COLGATE PALMOLIVE COMPANY & ANR. VS. ATUL SHAH AND ANR.
CS(COMM) 382/2026 | I.A. 9804/2026 | I.A. 9805/2026
For the Appellants/Petitioners: Rajeshwari H., Sarthak Sabbarwal
For the Respondents: Arnav Goyal, Nihal singh Shekhawat, Bhumika Kukreja, Aakriti Gupta
A modified trade dress is acceptable if it creates a clear visual distinction (such as through a dominant color change) and removes the possibility of confusion with a rival's trade dress, particularly when the trademarks themselves are different.
Headnote:The case involves a dispute over trade dress infringement regarding a 'BROOM' product. The court examined the compliance of the defendants with an interim order dated 10.04.2026, wherein the first defendant modified its packaging design to eliminate confusion and the second defendant, an intermediary, took down infringing listings. The court found that the modified trade dress, which incorporated a substantial portion of green color and distinct trademarks, was sufficient to prevent association with the plaintiff's product. The primary issue was whether the modified trade dress proposed by the defendant was sufficiently distinct to satisfy the plaintiff's grievances. The court reasoned that since the rival trademarks were different and the new trade dress established a clear visual distinction through its color scheme, the request for further modifications was unnecessary. In view of the aforesaid directions, the suit is disposed of alongwith all pending applications.
