A defendant in an infringement suit may be deleted from the array of parties upon demonstrating full compliance with court-ordered takedown directions and providing an undertaking to adhere to future orders.

Headnote:The matter involves a commercial suit where certain defendants sought deletion from the array of parties. The defendants filed applications stating that they had complied with the court's directions dated 10.09.2025 and submitted compliance affidavits to this effect. The court noted that the defendants had provided undertakings to comply with any future takedown orders passed against infringing parties. The primary issue was whether the defendants could be deleted from the proceedings upon demonstrating compliance with the court's directions. The court reasoned that since the directions were complied with and a necessary undertaking for future compliance was provided, the applications for deletion were maintainable. The application seeking deletion is allowed and the defendant no.9 may be deleted from the array of parties; similarly, the application seeking deletion is allowed and the defendant no. 2 may be deleted from the array of parties.
