Protection of personality and publicity rights against the unauthorized creation and dissemination of AI-generated deepfakes and morphed content.

Headnote:The plaintiff has filed a suit seeking a permanent injunction to protect personality and publicity rights against the unauthorized use of identity, likeness, and voice through artificial intelligence, deepfakes, and voice cloning. The plaintiff alleges that following a change in political affiliation, a campaign of malicious AI-generated content was launched. The suit seeks the removal of infringing content from intermediary platforms and damages for loss of reputation, referencing the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. The primary issue is whether the creation and dissemination of fabricated audio-visual content using AI technologies constitutes an infringement of the plaintiff's personality rights. The court is examining the necessity of interim relief to block access to derogatory deepfakes and the disclosure of the identities of the creators of such content. Judgment reserved.
