Headnote:The matter involves an application under Order XXIII Rule 3 read with Section 151 of the Code of Civil Procedure, 1908. The plaintiff and defendant no. 1 reached an amicable settlement where the defendant undertook not to use, market, or register the "DIAMOND" trademark or any deceptively similar mark and agreed to pay token damages of INR 30,000.
