For the Appellants/Petitioners: Samrat Nigam, Vaibhav Tomar, Prabhjot Singh Dhillon, Hriman Dhaka, Arpita Rawat
For the Respondents:
The court's procedural action in registering a defamation suit and issuing summons and notices for interim injunctions when a public official alleges that a publication contains false and disparaging claims regarding their professional conduct.
Headnote:The plaintiff, a former Deputy Superintendent of Jail No. 4, Tihar Jail, has filed a suit for permanent and mandatory injunction against the defendants to restrain the publication and propagation of a book titled “Black Warrant: Confessions of a Tihar Jailer”, an associated interview, and an audiobook. The plaintiff alleges that the content is defamatory and disparaging, specifically claiming that the book falsely alleges inmates escaped due to his negligence, an incident he asserts never occurred and for which no departmental inquiry was ever initiated. The primary issue is whether the impugned publications are false, misleading, and defamatory, thereby lowering the goodwill and reputation of the plaintiff in the eyes of the general public. The court has taken note of the prayers for rendition of accounts and the removal of defamatory content across various digital platforms including YouTube and Audible. List before the Court on 04.08.2026.
