A court cannot determine a prima facie case of defamation if the evidence provided in a foreign language lacks complete and accurate translations.

Headnote:The plaintiff filed a suit for defamation and sought an ad-interim injunction under Order XXXIX Rules 1 & 2 of the Code of Civil Procedure, 1908. The plaintiff alleged that certain videos and articles were defamatory in nature. The court observed that the evidence provided was in the Marathi language and the translations furnished were incomplete and disjointed. The court addressed whether a prima facie case for defamation could be established based on the provided documents. The court reasoned that because the translations were incomplete, it was "difficult for this Court to prima facie discern the essential ingredients of defamation from the documents on record" (Para 25). The prayer for ad interim relief shall be considered after the plaintiff places on record the complete English translation of the transcripts of the alleged defamatory videos and articles.
