For the Appellants/Petitioners: Ritika Vohra, Hardik Singh, Naveen Nagarjuna
For the Respondents: None
The court addressed procedural requirements for filing additional documents and court fees in a commercial suit for trademark infringement and passing off, while issuing notice for interim injunctive relief.
Headnote:The plaintiffs filed a commercial suit for trademark infringement and passing off under the Commercial Courts Act, 2015, and the Code of Civil Procedure, 1908, seeking to protect registered trademarks "Betapax", "Etosort", "Pregacon", and "Psycloze", and applied mark "Aripicon". The plaintiffs sought an ex-parte ad-interim injunction to restrain the defendants from using deceptively similar marks such as "Betakon-20" and "Pregakon" for pharmaceutical preparations. The court addressed procedural applications regarding the filing of additional documents under Order XI Rule 1(4) of the CPC and the extension of time for payment of court fees under Section 149 of the CPC. The primary issue is whether the defendants' pharmaceutical products infringe upon the plaintiffs' registered trademarks and constitute passing off. The court granted three weeks for filing additional documents, two weeks for affixing court fees, issued notice for the interim injunction application, and registered the plaint as a suit.
