W.P.(C) 11832/2026 | W.P.(C) 11833/2026
For the Appellants/Petitioners: Siddhant Sharma
For the Respondents: Rajesh Katyal, Seema Katyal
A challenge to restrictive tender conditions is barred by laches if the petitioner fails to challenge the stipulation immediately upon knowledge or rejection, particularly after the tender process has progressed to the stage of opening financial bids or issuing Letters of Award.
Headnote:(A) Tender Process - Eligibility Criteria - State-specific License - A stipulation requiring the lead partner of a Joint Venture to possess a specific state-issued electrical contractor license is challenged as arbitrary; however, failure to challenge such conditions immediately upon knowledge or rejection renders the petition belated. (Para 7, 8)
(B) Laches and Delay - Challenge to Tender Conditions - A petitioner cannot challenge the validity of restrictive tender stipulations after participating in the process and waiting until the financial bids are opened or Letters of Award (LOA) are issued. (Para 8, 9)
Issues: Whether the petitioner is entitled to challenge the restrictive license requirement in the tender after significant delay and after the issuance of the Letter of Award.
