2026 Supreme(Online)(Del) 17421
IN THE HIGH COURT OF DELHI AT NEW DELHI
Tushar Rao Gedela, J
Saleem Iqbal Shervani – Appellant
Versus
Meta Platforms Inc – Respondent
CS(OS) 676/2026|I.A. 20739/2026
For the Appellants/Petitioners: Abhishek Singh, J. Amal Anand, Elvin Joshy, Shivani Kalra, K.V. Vibu Prasad, Akshat Mishra
For the Respondents:
The court held that AI-generated videos falsely depicting a public figure as being associated with criminals are defamatory, justifying an ad-interim injunction to remove the content from social media platforms to prevent irreparable reputational harm.
Headnote:(A) Defamation - AI-Generated Content - Use of artificially created videos depicting a public figure in a derogatory manner, falsely associating them with criminal elements, constitutes a prima facie case of defamation. (Para 20)
(B) Intermediary Liability - Takedown Order - Direction to social media platforms to remove specific URLs containing defamatory AI-generated content to prevent irreparable harm to the plaintiff's reputation. (Para 22)
(C) Interim Injunction - Balance of Convenience - Grant of ex-parte ad-interim injunction under Order XXXIX Rules 1 & 2 of CPC when the plaintiff establishes a strong prima facie case and irreparable injury. (Para 21)
Issues: Whether the AI-generated videos are defamatory and whether an ad-interim injunction should be granted to remove the content from social media platforms.
