ORDER

1. This Appeal is filed against the order dated 10.11.2023 in SA 6/2023 on the file of DRT -I, Chennai.

2. The Appellant filed SA 6/2023 before DRT-I, Chennai, challenging the Sale Notice dated 06.03.2023 for sale of movables. After the contest, Learned Presiding Officer was pleased to hold that the sale held on 20.03.2023 in pursuance of Sale Notice dated 06.03.2023 was held in accordance with the provisions of SARFAESI Act and Rules made thereunder and the Tribunal does not interfere in the Sale. However, an option was made available to the Appellant that if the Appellant is interested in retaining the movable goods sold in auction, 1st Respondent Institution was directed to hand over the movables on “as is where is basis”, on deposit of entire sale consideration along with interest at 9% p.a. on or before 27.11.2023, with 1^st Respondent Institution; on such deposit made, the entire proceeds of deposit be refunded to 2^nd Respondent, the Auction Purchaser; if the amount is not deposited by the Appellant, the 2nd Respondent was permitted to remove the goods along with certain other directions. Challenging the order passed and directions issued, this Appeal is filed.
