2024 Supreme(Online)(GAU) 199

HIGH COURT OF GAUHATI
Susmita Phukan Khaund, J
DANI RAM DAS @ DANPTI (DANI) – Appellant
Versus
THE STATE OF ASSAM – Respondent
AB / 1137 / 2024

Advocates:
MR. B. DAS

The court ruled that pre-arrest bail is unnecessary for bailable offences, affirming that no apprehension of arrest exists.

Headnote:(A) Criminal Procedure Code, 1973 - Section 438 - Pre-arrest bail - Application for pre-arrest bail rejected as the alleged offences are bailable and do not warrant apprehension of arrest. The petitioner is accused of assaulting the informant's husband, causing injuries. (Paras 2-8)

(B) Bailable Offences - The court found that the offences under Sections 325 and 326 IPC are bailable, thus negating the need for pre-arrest bail. (Paras 7-8)

Facts of the case:
The petitioner, facing allegations of assault causing injuries to the informant's husband, sought pre-arrest bail, fearing arrest in a case registered under IPC.

Findings of Court:
The court determined that the alleged offences are bailable and no apprehension of arrest exists.

Issues: The main issue was whether pre-arrest bail should be granted given the nature of the alleged offences.

Ratio Decidendi: The court held that since the offences are bailable, there is no necessity for pre-arrest bail, and the apprehension of arrest is unfounded.

Result: Petition for pre-arrest bail rejected.

3. Heard Mr B B Gogoi, learned Additional Public Prosecutor for the State of Assam/respondent.

4. I have perused the Case Diary.

5. The allegation against the petitioner is that he assaulted the informant’s husband causing grave injuries on his person.

6. Perused the FIR and the injury report which reveals that the informant’s husband, i.e., Srikanta Das sustained simple injuries caused by blunt object. 7. Thus, the offence alleged is a bailable offence. The other offence under which the petitioner is booked is Section 447 IPC. Thus, there is no apprehension of arrest in connection with the offence as alleged.

8. Hence, the petition with prayer for pre-arrest bail is rejected at this stage. 9. Send back the Case Diary.
