03-12-2024 Heard Mr. H K Das, learned counsel for the petitioners and Mr. K K Parashar, learned Additional Public Prosecutor, Assam for the State.

2. Apprehending their arrest, the petitioners, namely, (i) Smti. Chayanika Kashyap daughter of Sri Atul Ch. Kalita; (ii) Sri Nilutpol Gogoi, son of Sri Dilip Kumar Gogoi; (iii Smti. Massar Borah, daughter of Sri Mrigen Ch. Borah; (iv) Sri Santanu Chakraborty son of Sri Nripen Chakravorty and (v) Smti. Sonia Rabha, daughter of Mohendra Rabha have filed this application under Section 438 CrPC, seeking pre arrest bail in Dispur Police Station Case No. 538/2024 registered under Sections 406/420 of IPC, corresponding to G.R. No. 3167/2024.

3. The complainants on 31.05.2024 lodged the FIR of the case before the Officer-in-

Charge of Dispur Police Station alleging that the accused persons of the case had entered into an agreement with them in the name of Vihaan QNet, but they had malafide intentions in terms of international business opportunities by showing them false benefits from the business and their working model, for which they had invested huge amounts, but did not receive the benefits in terms of the agreement they had executed with
