Date : 17.02.2024 Case taken up before the Lawazima Court.
None appears on behalf of the petitioner.
Perused the records.
The office note dated 03.02.2024 reveals that in compliance with the order of the previous Lawazima Court dated 18.11.2023, notice was issued to the sole respondent by registered post with A/D as well as by usual process on 19.12.2023.
Now, in regard to the notice issued by usual process, no service report has been received back.
Further, in regard to the notice issued by registered post with A/D, neither the A/D card nor the un-served notice has been received back. However, a perusal of the postal track consignment report available with the case record reveals that the notice in respect of the respondent No. 9 has been delivered to the addressee on 30.12.2023. As such, service is complete in respect of the said respondent (respondent No. 9).
Furthermore, it may be mentioned that the aforesaid Lawazima Court dated 18.11.2023 had directed the petitioner to obtain instructions regarding the present address of respondent Nos. 10 & 11. However, no one appeared before the Lawazima Court today to provide information regarding the present address of the said respondents.
In view of the above, the petitioner is again granted 7 (seven) days time to obtain instruction regarding the present address of the respondent Nos. 10 & 11.
Let the matter be listed again before the Lawazima Court 26.02.2024.
