ORDER

Date : 18 .11. 2024 Heard Mr. R.A. Choudhury, learned counsel for the petitioner and Mr. R.J. Baruah, learned Addl. Public Prosecutor, Assam, appearing on behalf of the State respondent.

This is an application under Section 482 of the BNSS, 2023, seeking pre-arrest bail by the petitioner namely Masum Uddin Laskar @ Masum Ahmed Laskar in connection Algapur P.S. Case No. 66/2023 (Corresponding to G.R. Case No. 417/2023 under Sections, 448/ 354/ 376/ 313/ 294/ 323/ 34 IPC read with Sections 67/66 of IT Act.

It is submitted by Mr. Choudhury, the learned counsel for the petitioner that the petitioner has falsely implicated in the alleged offence only to harass him. However, it is the fact that the present petitioner had love relationship with the informant and due to misunderstanding she lodged the FIR. Subsequently, the informant has filed compromise petition before the learned trial Court stating that she has no objection, if the bail is granted to the petitioner, but the bail was rejected by the trial court below and hence this bail application.

Now the petitioner is ready and willing to co-operate with the investigation, if he is granted the privilege of pre-arrest bail by this Co
