Heard Mr. G. Alam, learned counsel for the petitioner and Mr. D.P.

Goswami, learned Addl. P.P. for the State.

2. By filing this criminal revision petition under Section 401 read with Section 397 Cr.P.C., the petitioner, namely, Md. Anisur Rahman, has assailed the judgment and order dated 01.06.2022, passed by the learned Addl. Sessions Judge, Sivasagar in Crl. Appeal No. 10(2)/2020, thereby dismissing the appeal and affirming the impugned judgment and order dated 30.05.2020, passed by the learned Chief Judicial Magistrate, Sivasagar in N.I. Case No. 41/2016, thereby sentencing the petitioner to pay a fine of Rs.4,20,100/- to the respondent no. 2 along with interest at the rate of 9% per annum from the date of the order till final payment, and in default, to suffer simple imprisonment for five months.

3. Issue notice of motion returnable on 05.12.2022.

4. No formal step is required to be taken in respect of respondent no. 1 as the State is represented by the learned Addl. P.P. However, the petitioner shall take steps for service of notice on the respondent no. 2 by registered post as well as through usual process.

5. Call for the records of (1) Crl. Appeal No. 10(2)
