Date : 23-03-2022 Heard Mr. R. Saikia, learned counsel for the applicants. Also heard Mr. T.
Mehta, learned Solicitor General of India (SGI), appearing on behalf of the State respondents and Mr. S. Jain, learned Senior Counsel appearing on behalf of NHPC.
2. It is to be noted here that since NHPC has not been made a party here in this application, Mr. S. Jain, learned Senior Counsel has supplemented the submission advanced by Mr. Mehta, learned SGI on behalf of State respondent.

This Interlocutory Application has been preferred by the applicants, Shri Ano Umpe & 99 Ors., praying for a direction to the Land Acquisition Collector/Deputy Commissioner (LAC/DC), Dibang Multipurpose Project (DMP) (2880 MW), to disburse the compensation to the applicants under protest without prejudice to the pendency of the writ petition under the law and also in terms of similar order dated 10.03.2022, passed by this Court in WP(C)/245(AP)/2021 (Shri Niranjan Milli & Ors. Vs. State of Arunachal Pradesh). It is to be mentioned here that the applicants are the projected affected families (PAF), whose lands are acquired for DMP (2880MW) pursuant to the Notification dated 06.10.2018, and Award dated 07.09.2018.

The contention of the applicants are that they have filed one writ petition, being WP(C)/60(AP)/2022, for a direction to the LAC/DC Collector, DMP (2880MW), Dibang Valley District, Anini, to disburse compensation amount to the petitioners, so deposited by the NHPC, and allowing the petitioners to received the compensation under protest, in terms of Section 77 of the RFCTLARR Act, 2013, with an interim prayer to direct the LAC/DC, DMP (2880MW), Dibang Valley District, Anini, to disburse compensation amount and to receive the compensation under protest, pending disposal of the writ petition. But, after hearing the parties, this Court refused to grant any interim relief on the ground that the interim order, as prayed for by the petitioners in that writ petition, will not, however, in any manner facilitate the early resolution of the dispute between the parties and, thereafter, issued notice to the respondents.

Then being aggrieved by the aforementioned order, the petitioners preferred one writ appeal, being WA/78/2022, before the Division Bench of this Court in the Principal Seat and the learned Division Bench, vide order dated 02.03.2022, has requested the learned Single Judge to dispose of the writ petition as expeditiously as possible. Thereafter, the applicant filed this Interlocutory Application with the prayer discussed herein above.
6. The respondent/LAC/DC DMP, also filed one affidavit-in-opposition denying the averments made in the application and opposed the prayer being made by the applicants. It is stated that execution of the project has been delayed considerably due to delay in acquisition of land in Lower Dibang Valley and Dibang Valley District which lead to huge escalation of cost. And towards the aforesaid issues, a consensus emerged that in the public interest, it is desirable to arrive at a mutual acceptable settlement agreement based on agreed parameters and the order of this Court, dated 19.02.2021, has paved the way for arriving at such a settlement by adjourning the case by 6 (six) weeks, to enable the parties to make an endeavour to make an amicable settlement. Accordingly, the parameters have been worked out for an amicable settlement in the tune with legal provision and to accommodate the legitimate interests and aspirations of the project affected families and on the basis of the said parameters, payment was disbursed to the project affected families and out of 79 project affected families, all the 79 families have agreed to the settlement and received the payment in Lower Dibang Valley District and in Dibang Valley District, out of 782 project affect families, 704 families had agreed to the settlement and received the compensation and the final compensation was worked out in terms of the agreed parameters and
