Heard Mr. BS Lahkar, who has appeared in person for both the petitioners and Mr. D Saikia, learned Sr. Addl. Advocate General, Assam assisted by Mr. D Nath, learned Government Advocate, Assam.
02. By filing this petition under Article 226 of the Constitution of India, petitioners seek quashing of order dated 21.06.2018 passed by the Registrar of Cooperative Societies, Assam and further seek a direction to the respondents to let the petitioner No.1 carry on its functioning without any hindrance.
03. By the order dated 21.06.2018, Registrar of Cooperative Societies, Assam (Registrar) recorded a finding that Assam Flying Club Ltd. as a cooperative society still exists; referring the matter to the State Government to restore and revive functioning of the cooperative society by the name of Assam Flying Club Ltd. and if that is not possible to take appropriate steps. By the said order, Director of Sports and Youth Welfare, Assam and petitioner No.2 were directed to hand over documents and properties of Assam Flying Club Ltd. to Sri Anil Hazarika, Joint Registrar of Cooperative Societies, Guwahati, who was directed by the Registrar to take over charge of the affairs of
