ORDER
Date : 30-11-2018 Heard Mr. D Senapati, learned counsel for the petitioner and Mr. SC Keyal, learned Assistant Solicitor General of India.
By filing this petition under Article 226 of the Constitution of India, petitioner seeks quashing of the decision of the respondents in declaring the petitioner to be out of race of the tender process and further seeks a direction to the respondents to treat the petitioner as technically responsive and thereafter to consider the price bid of the petitioner along with other technically responsive bidders.
Matter relates to e-Tender of Central Public Works Department (CPWD), Government of India for the following work: -
“ DBT Animal House Facility at RMRC, Dibrugarh (Assam). (SH : Building work (G+3) i/c internal electrical installations, lift, firefighting, fire alarm, lands caping and allied works (Package-I).”
When the writ petition was moved on 22.11.2018, learned Assistant Solicitor General submitted that he would produce the relevant record. An interim order was passed to the effect that till consideration of the matter, respondent Nos.1 to 4 should not finalize the tender.
The matter was heard at the motion stage itself yesterday.
