06.12.2022 Heard Mr. S.M. Abdullah P, learned counsel for the petitioner and Mr. B. Sarma, learned Additional Public Prosecutor for the respondent State of Assam.

2. By this application under Section 438, Code of Criminal Procedure, 1973 [CrPC], the petitioner viz. Dr. Sarat Kumar Dutta has approached this Court seeking the benefit of pre-

arrest bail, apprehending her arrest, in connection with CID Police Station Case no. 5/2022, registered under Sections 120B/420/468/471, Indian Penal Code [IPC] with Section 467, IPC added later on.

3. Mr. Abdullah, learned counsel for the petitioner has submitted that the petitioner was the former Principal of Dhing College, who retired from service on 31.12.2019 on reaching the age of superannuation. Mr. Abdullah has further submitted that, at present, the petitioner is suffering from Kidney ailment and on 06.03.2022, he was discharged from M/s Akash Health Care Super Specialty Hospital, Delhi after his successful operation. It is submitted by Mr. Abdullah that the petitioner has no role in issuance of any of the computer efficiency certificates which the 4 nos. of candidates, [i] Oli Ullah, [ii] Firuj Ahmed, [iii] Atikur Rahman and [iv] Mus
