Date : 18-12-2018 Heard Mr. KP Pathak, learned counsel for the petitioner; Mr. SR Baruah, learned Government Advocate, Assam; and Dr. B Ahmed, learned Standing Counsel, Cooperation Department, Government of Assam.

By filing this petition under Article 226 of the Constitution of India, petitioner seeks a direction to the respondents, more particularly, respondent No.3 i.e., Registrar of Cooperative Societies, Assam to pass necessary orders on the appeal filed by the petitioner.

It is stated that petitioner is a member of Geramari Samabay Samiti Ltd. (Society), which is a cooperative society governed by the provisions of the Assam Cooperative Societies Act, 2007 (2007 Act). In the Annual General Meeting (AGM) and election of the Society which was held on 10.05.2018, respondent No.8 Jasher Ali Khan was elected as member of the Board of Directors. Contention of the petitioner is that respondent No.8 for various reasons was not eligible to participate in the election. His participation and election is, therefore, illegal.
