Heard Mr. M.A. Sheikh, learned counsel for the petitioners. Also heard Mr. J. Handique, learned standing counsel for the Revenue Department, representing respondent no. 1, and Mr. R. Dhar, learned Addl. Senior Government Advocate for respondent nos. 2 to 7.
2) The learned counsel for the petitioners has submitted that the case of the petitioners, in brief, is that the Government had taken a decision to appoint Gaonburah on honorary basis in each revenue village, save and except in the area covered by the Sixth Schedule to the Constitution of India and that the decision to that effect was communicated to all Deputy Commissioners by letter dated 10.01.2000, issued by the Commissioner and Secretary to the Government of Assam, Revenue Department (respondent no.1). Accordingly, the Deputy Commissioner, Goalpara (respondent no.2), vide letter dated 26.06.2000, informed the Circle Officers/ Tehsildars/ Block Development Officers under his establishment that no applications were submitted for appointment to the post of Gaonburah/ Additional Gaonburah and therefore, they were asked to collect applications from the respective sanctioned areas and submit the same on or b
