07.09.2021 Heard Mr. R. C. Saikia, the learned counsel for the applicant. Also heard Mr.
R. Sarma, the learned counsel appearing on behalf of the opposite party/ the Oriental Insurance Co. Ltd and Mr. S. Sahu, the learned counsel for the opposite party Nos. 2 and 3.
This is an application seeking for a direction to the Registry of this Court for release of the 50% of the awarded amount against the award dated 09.12.2020 passed in MAC Case No. 1754/2012 by the learned Additional District & Sessions Judge No. 3, FTC –cum- Member, MACT, Kamrup (M), Guwahati. The opposite party Insurance Company filed the connected MACAppl./43/2021. While admitting the appeal, this court vide order dated 01.03.2021 directed the opposite party Insurance Company to deposit 50% of the awarded amount before the Registry of this court against the stay order.
Mr. Sarma fairly submits that he has no objection in the event an appropriate direction is passed by this Court to the Registry.
In view of the same, this application is disposed of thereby directing the Registry to release the 50% awarded amount deposited by the opposite party Insurance Company in terms of the order dated 01.03.2021 passed in MACAppl./43/2021.
The Registry shall release the said amount subject to the satisfaction of the identity of the applicant concerned.
With the said observation, this application stands disposed of.
