16.12.2022 Heard Mr. S.R. Rabha, learned counsel for the petitioner and Mr. B. Sarma, learned Additional Public Prosecutor for the respondent State of Assam.

2. By this application under Section 438, Code of Criminal Procedure, 1973 [CrPC], the petitioner viz. Sri Tapan Das has approached this Court seeking the benefit of pre-arrest bail, apprehending his arrest, in connection with CID Police Station Case no. 5/2022, registered under Sections 120B/420/468/471, Indian Penal Code [IPC] with Section 467, IPC added later on.

3. Mr. Rabha, learned counsel for the petitioner has submitted that the petitioner, at present, is serving as an Assistant Teacher at No. 951 Bhalukabari L.P. School. It is the case of the petitioner that prior to appointment of the petitioner as Assistant Teacher, he used to run a centre, “Sahaj Arunodoy Kendra” [‘the Centre’] which was a single window point for delivery of public services. From the said Centre, many persons obtained computer efficiency certificates by enrolling themselves in online computer courses.
