ORDER

16.12.2022 Heard Mr. N. Pathak, learned counsel for the petitioner and Mr. B. Sarma, learned Additional Public Prosecutor for the respondent State of Assam.

2. By this application under Section 438, Code of Criminal Procedure, 1973 [CrPC], the petitioner viz. Sri Diganta Borah has approached this Court seeking the benefit of pre-arrest bail, apprehending his arrest, in connection with CID Police Station Case no. 5/2022, registered under Sections 120B/420/468/471, Indian Penal Code [IPC] with Section 467, IPC added later on.

3. Mr. Pathak, learned counsel for the petitioner has submitted that the petitioner is a founder of a computer institute, “Computer Education Institute” [CEI] having Trade License no. 5423 [old] and 4435 [new] dated 06.04.2022 w.e.f. 01.04.2021 to 31.03.2023, located at Old Circuit House Road, Jorhat. The institute had trained a number of students and after completion of their training, certificates used to be distributed to the successful candidates. The petitioner has approached this court by the instant application as in the first part of the year 2022, personnel from the Investigating Agency [CID] had visited the institute of the petitioner for enquiring
