ORDER
Date : 20-07-2018 Heard Mr A Sarma, learned counsel for the petitioner and Mr T C Chutia, learned Government Advocate, Assam.
2. By filing this petition under Article 226 of the Constitution of India, petitioner seeks quashing of order dated 18.04.2018, passed by the Joint Secretary to the Government of Assam, Fishery Department, rejecting the representation of the petitioner seeking waiver of Government revenue for operating the Sessa Nadi Fishery in the district of Dibrugarh as well as the demand notice dated 02.06.2018, calling upon the petitioner to clear the outstanding arrear dues of the said Fishery for the years 2014-15, 2015-16, 2016-17 and 2017-18.
3. Following a tender process, petitioner was settled with the Sessa Nadi Fishery (Fishery) at its offered bid value of Rs. 10,50,999.00 per annum for a period of 7 (seven) years from the date of delivery of possession vide the order dated 17.05.2014 of the Deputy Secretary to the Government of Assam, Fishery Department.
4. Petitioner submitted a representation on 25.01.2016 to the Joint Secretary to the Government of Assam requesting the said authority to ascertain the loss suffered by the petitioner on account of discharge
