ORDER

27-05-2020 Heard Mr. A. Ahmed, learned counsel for the petitioner and Mr. M. P. Goswami, learned Additional Public Prosecutor, Assam for the State.

By this application under Section 439 CrPC, the petitioner, namely, Mugal Hussain Paramanik is seeking bail in Dhubri Police Station Case No. 64/2020 registered under Sections 22(C) of the NDPS Act, (corresponding to G.R. No.160/2020) wherein the petitioner was arrested on 10.01.2020 and since then, he is in custody.

As per the FIR of the case, specific input from reliable source was received that the petitioner and another namely, Abul Hussain Paramanik are involved in the illegal trade of contraband articles and drugs and when they were searched on the intervening night of 09.01.2020 and 10.01.2020, from their possession, police found 29 numbers of contraband cough syrup and 48 numbers of Simplex+ capsules, which were accordingly seized and they were apprehended by police.

Mr. M. P. Goswami, learned Additional Public Prosecutor, Assam has placed the status report of the case submitted by the concerned Investigating Officer of said Dhubri P. S. Case No. 64/2020.
