ORDER

Date : 11-01-2019 Heard Mr. A. Gautam, learned counsel for the petitioner and Mr. D. Saikia, learned Senior Counsel assisted by Mr. P.N. Goswami, learned counsel for Assam Cricket Association/respondent No. 1.

2. In this writ petition filed under Article 226 of the Constitution of India, petitioner has assailed the legality and validity of the election notification dated 18.12.2018 for holding election to elect office bearers of Assam Cricket Association (ACA) on 12.01.2019 as well as to declare the election and all related orders as null and void.

3. Prime contention of learned counsel for the petitioner is that Hon’ble Supreme Court vide order dated 05.07.2018 passed in Civil Appeal No. 4235/2014 (Board of Control for Cricket in India –Vs- Cricket Association of Bihar) had directed that no election should be held thereafter. Therefore holding of election which is scheduled tomorrow i.e., on 12.01.2019 is illegal.
