Date : 12-11-2021 Heard the learned counsel for the petitioner and the learned counsel for the respondents.

2. The grievance of the writ petitioner in the instant writ petition is that though he has having more than 20 years 7 months of continuous service since his date of initial appointment on 01.05.1991 as M.R. worker, under the establishement of excecutive engineer, PWD, Nalbari. The petitioner superannuated from service on 30.11.2011. His Service was regularized vide order dtd.30.09.2005 (Annexure). His pension papers were duly submitted by his employer before the Accountant General (A&E). In between there were some deficiencies in paper works and a certificate regarding continuation of service of the petitioner was sought for by the Accountant General (A&E), which was duly given by the employer of the petitioner. However, vide communication issued in October 2014 (Annexure-9), the Office of the Accountant General (A&E) expressed the view that petitioner is not eligible for pension and gratuity etc. as he has less than 20 years of service counting initial appointment as on

01.05.1991 after deducting initial six years of Muster Roll service.
