GAUHATI HIGH COURT
MR. JUSTICE SOUMITRA SAIKIA, J
SRI PRADIP KUMAR TALUKDAR – Appellant
Versus
THE STATE OF ASSAM – Respondent
WP(C)/2826/2025
For the Appellants/Petitioners: MR. D DAS SR. ADV, MS T PARASHAR
For the Respondents: GA, ASSAM, SC, APSC
The imposition of a penalty on a pensioner without adherence to the prescribed legal procedures warrants judicial scrutiny.
Headnote:This case concerns the challenge of a penalty imposed under Rule 21 of the Assam Services Pension Rules, 1969, and Rule 9 of the Assam Services (Discipline & Appeal) Rules, 1964. The petitioner argues the initiation of departmental proceedings contravenes prescribed legal provisions. The court's initial findings suggest potential violations that warrant further consideration. Issues include the legality of the penal order and its procedural propriety. The court observes the necessity for interim relief pending a definitive decision on the matter. The hearing for interim considerations is set for 24.06.2025.
