Proper service of notice is established through postal tracking despite lack of A/D cards.

Headnote:The court addressed the service of notices to respondents Nos. 3, 4 & 5, noting that while A/D cards were not received, postal track reports confirmed delivery on 02.04.2025. The court concluded that service has been completed. The matter is to be placed before the Hon’ble Court.

Learned counsel Ms. Tinlung appears on behalf of Mr. R.K. Talukdar, learned counsel for the petitioners. Heard.

Perused the records.

Perusal of the office note dated 16.05.2025 reveals that notice was issued to the respondent Nos. 3, 4 & 5 by registered post with A/D on 25.03.2025.

But, in regard to the aforesaid notice issued to the respondent Nos. 3, 4 & 5, it appears that neither the A/D cards nor the un-served notices have been received by the concerned section as of yet.

Despite the aforesaid, it has been observed that the postal track consignment reports regarding the aforesaid notice issued to the respondent Nos. 3, 4 & 5 are available with the case record, which reveals that the notice in respect of the said respondent has been delivered to the addressees on 02.04.2025. As such, it may be said that service in respect of the respondent Nos. 3, 4 & 5 has been completed.
