Advocates:
For the Appellants/Petitioners: Mr. C Tlanthianghlima
For the Respondents:

Delay in filing appeal can be condoned under Limitation Act when justified, as evidenced in this application.

Headnote:This judgment pertains to an application under Section 5 of the Limitation Act, 1963, seeking condonation of delay of 889 days in filing a connected MAC appeal arising from a decision by MACT Aizawl, dated 14.12.2022. The court expressed the necessity to issue notices to the respondents and outlined the steps required for the service of notices by the appellant's counsel. The principal issue tackled was whether the delay in filing the appeal could be condoned under the Limitation Act. The court reasoned that there were sufficient grounds to consider the application, hence indicating a favorable approach toward the appellant's request. The result determined that the issue of notice returnable in four weeks was imperative, along with further procedural instructions regarding serving notices to the respondents.
