ORDER

Date : 08-01-2026 There is a dispute on the claim made by the petitioners that they are still working as Gardeners being appointed by the erstwhile Bodoland Autonomous Council. The respondents/BTC, on the other hand, at paragraph 3 of their counter-affidavit has stated that appointments were made against non-sanctioned and non-existent posts without due process of law and therefore all the appointments have been terminated on 12.11.2004. Although the termination order is annexed as Annexure-1 to the counter-affidavit, but the same appears to be a general order without mentioning any specific names.

Under the circumstances, Ms. N Choudhury, learned Standing Counsel, BTC shall obtain instructions and produce the relevant records to show that the services of the petitioners have already been terminated by the order dated

12.11.2004.

List the matter again on 10.02.2026.
