ORDER

Date : 16.12.2025 Case taken up before the Lawazima Court.

Learned counsel Mr. Subham Dutta appears on behalf of Mr. Sishir Dutta, learned counsel for the appellants. Heard.

Perused the records.

A careful perusal of the case record reveals that the petitioner had taken fresh steps for service of notice upon the sole respondent by way of registered post with A/D as well as by usual process on 06.02.2025.

However, the said notices could not be issued due to the lack of written up notices supposed to be annexed with the steps submitted by the appellants. As such, the subsequent Lawazima Court’s orders dated 17.03.2025 & 12.11.2025 had directed the appellants to submit the requisite written up notices to the concerned section.

But so far, no such written up notices have been submitted to the registry and as such Although, the appellants have submitted the steps for issuance of notice through registered post with A/D, as per the recent development, the Indian Post Office has discontinued its registered post with A/D service. As such, this Lawazima Court hereby directs the appellants to take fresh steps for service of notice upon the sole respondent by way of speed post mode, in terms of the Notification No. 85 dated

15th October, 2025 (at Flag-‘N’).

Further, the appellants are directed to submit requisite written up notice to the concerned section for issuance of the usual process notice and upon submission of such written up notice, the concerned section is directed to issue Let the matter be listed again before the Lawazima Court on 28.01.2026.
