2. By filing this writ petition, the petitioner has challenged the public notice/paper publication by the Recovery Officer, Assam Tea Employees Provident Fund Organization (‘ATEPF’, in short), whereby a final notice is given to the creditors of Balimara Tea Estate and general public calling upon them to submit their financial claims and proof, pursuant to the public auction sale of Balimara Tea Estate vide Auction Notice dated 07.09.2021 and order of confirmation of sale dated 08.11.2021. The petitioner has prayed for refund of the surplus amount arising out of the auction sale and to restrain the Recovery Officer from making payments to the financial and other creditors who have lodged their purported claims pursuant to the impugned public notice.

3. The petitioner is a company incorporated under the Companies Act, 1956 and the owner of the Balimara Tea Estate, having its registered office at Balimara Tea Garden P.O. Naharkatia, Dibrugarh, Assam. The Balimara Tea Estate was purchased in the year 2017 and has a total area of 247 hectares, out of which 139 hectares are under plantation, while the remaining area is utilized for other infrastructural facilities and for the production of the green tea.
