1. Heard Mr. H. C. Sarma, the learned counsel appearing on behalf of the petitioners.

2. This is an application filed by invoking the supervisory jurisdiction of this Court under Art.227 of the Constitution thereby challenging the order dated 26.11.2024 passed in Title Suit No.177/2022 by the Court of the learned Civil Judge, (Junior Division) No.4, Kamrup (M) at Guwahati whereby the learned Trial Court on account of not depositing the cost of Rs.3,000/- on 30.09.2024 and 04.10.2024, restored the order dated 01.03.2024.

3. This Court having perused the impugned order and also taking into account the manner in which the jurisdiction has been exercised by the learned Trial Court, i.e. the Court of the learned Civil Judge, (Junior Division) No.4, Kamrup (M) at Guwahati is of the opinion that even without issuance of notice upon the respondent, appropr
