ORDER

Date : 06.02.2026 Case taken up before the Lawazima Court.

None appears on behalf of the petitioner.

Perused the records.

A careful perusal of the instant case record reveals that the Hon’ble Court vide its order dated 19.06.2025 had directed the petitioner to take fresh steps for service of notice upon the respondent Nos. 2 to 5 by way of registered post with A/D mode. Vide the said order, the petitioner was also permitted to take fresh steps upon the said respondents by way of dasti mode.

Consequently, it appears that notice was issued to the respondent Nos. 2 to 5 by way of registered post with A/D on 24.06.2025 and by way of dasti mode on 21.06.2025.

Meanwhile, it appears that the learned counsels have entered appearance on behalf of the respondent No. 5 by filing Vakalatnama. As such, it may be said that service in respect of the respondent No. 5 has been completed.

Further, in respect of the above mentioned notices issued to the remaining respondents, i.e., respondent Nos. 2, 3 & 4, this Lawazima Court has observed as follows:–

In respect of the notice issued through registered post with A/D:–

(i) The A/D card in respect of the respondent No. 2 has been received bearing the purported signature of the said respondent.

(ii) In respect of the notices issued to the respondent Nos. 3 & 4, it appears that neither the A/D cards nor any un-served notices have been received by the registry till date. Moreover, the postal track consignment details regarding the said notice are also not available at the Indian Post Website.

In respect of the notice issued through dasti mode:– The petitioner has filed an affidavit regarding service of said dasti notice issued upon the respondent Nos. 2, 3, 4 & 5. In the said affidavit, it has been inter alia stated that:–

“3. ................ upon receipt of the notice from the Registry on 21.06.2025 I served the same upon the Respondents which was duly received by the respondent No. 2, 3 & 4 on 23.06.2025 at their Regional Office, Guwahati.

4. That on 23.06.2025 the Respondent No. 5 although received the Notice of this Hon’ble Court along with the copy of the petition but he refused to put his signature on the service copy.”

In view of the observations made above, it may be said that service of notice upon the respondent Nos. 2, 3 & 4 has been completed as well. Accordingly, the matter may be placed before the Hon’ble Court.
