ORDER

Date : 11.02.2026 Heard R. Saha, learned counsel for the petitioners and Mr. S.R. Baruah, learned Junior Government Advocate, Assam for the State respondents.

The petitioners have stated that the petitioner no. 1-firm deals in supply of office materials and hardware articles, electronic equipments, bamboo products and motor vehicle spare parts and accessories, etc. In the course of business, they had supplied motor vehicle spare parts and accessories to the office of the Commissioner, Guwahati pursuant to work- orders issued by the said office, annexed as Annexure-A series to the writ petition, from time to time. The petitioner has projected that despite submissions of bills duly, the respondent authorities have not released the entire bill amount to the petitioners. As a result, an amount of Rs. 47,50,964/- has remained outstanding till date. As the said amount has not been disbursed despite approaches and submission of representations from the petitioners, the petitioner is before this Court by the present writ petition.

Mr. Baruah, learned Junior Government Advocate, Assam appearing for the State respondents has submitted that the petitioner has only annexed the work-orders and there is no admissibility statement from the Head of the Department in terms of the Full Bench decision in Tamsher Ali and others vs. State of Assam and others, reported in is not maintainable.

Issue notice, returnable on 20.03.2026.

As Mr. Baruah has appeared and accepted notices on behalf of the State respondents, issuance of formal notice in respect of the respondents stand dispensed with. The learned counsel for the petitioners shall serve requisite nos. of extra copies of the writ petition along with annexures, to Mr. Baruah within 2 [two] working days from today.

Department in conformity with the Full Bench in Tamsher Ali [supra], the issue of maintainability of the writ petition is kept open for consideration.
