ORDER

Date : 10.02.2026 Case taken up before the Lawazima Court.

Learned counsel Mr. K.J. Hazarika appears on behalf of the petitioner. Heard.

Perused the records.

The instant matter has been carefully perused and upon such perusal, it has been observed that, vide the Lawazima Court’s order dated 23.06.2025, the matter was laid before the Hon’ble Court due to non compliance of the earlier Lawazima Court’s orders for taking fresh steps upon the respondent No. 5.

Consequently, the matter was listed before the Hon’ble Court on 28.01.2026 and on that day, the learned counsel for the petitioner had submitted that steps upon the respondent No. 5 was taken on 26.06.2025. Accordingly, the Hon’ble Court has been pleased to direct the Registry to verify the submission made above and further directed to submit a report regarding service of notice upon the said respondent. Pursuant to the above, the matter is listed today with an office note 07.02.2026, wherein, it has been stated that the petitioner did take fresh steps for service of notice upon the respondent No. 5 through usual process in compliance with the Lawazima Court’s order dated 03.01.2025.

In the said office note dated 07.02.2026, the concerned section has quoted an order dated 04.06.2025 (at Flag-‘ORDER’) passed in WP(C)/6906/2023, wherein, the Hon’ble Court has inter alia stated that:–

“While the learned Lawazima Court can look into the matter of completion of service in the matter indicated by this Court, the aspect regarding the mode of such notice should not be part of such orders to be passed”.

Since, there is no order of the Hon’ble Court for taking fresh steps by way of usual process, the issuance of notice against the steps submitted by the petitioner will be in contradiction to the above quoted order of the Hon’ble Court. As such, notice to the respondent No. 5 could not be issued.

In view of the observations above, the petitioner is directed to take fresh steps for service of notice upon the respondent No. 5 by way of speed post mode, in terms of the Notification No. 85 dated 15^th October, 2025 (at Flag-‘N’), within 7 (seven) days from the date of this order.

Let the matter be listed again before the Lawazima Court on 11.03.2026.
