Although no one appears on behalf of the petitioner on call, this
Court has perused the writ petition and other documents available on
record. The mediation report reveals that the mediation between the
parties have failed.
The husband of the petitioner had expired on 01.07.2005 while
serving as a Government employee. Neither the provisional family pension
nor the regular family pension has been paid to the family of the petitioner
till date.
The writ petition was instituted in the year 2019. By the order

dated 13.02.2020, this Court had recorded a submission made on behalf
of the Department that the petitioner’s husband was an Ex-Accountant
and was a regular government employee working under the establishment
of Block Development Officer, Lumbajong Block, Manja, Karbi Anglong
district who died in harness on 01.07.2005. Notice was issued on the same
date itself.
It is from that date, submissions have been made that efforts are
being made for reconstructing of the service book of the husband
petitioner. In fact, by the order dated 17.11.2020, this Court observed that
the respondents are expected to take a serious view of the matter.
Today, the learned counsel appearing for the P&RD Department
submitted that an accommodation of 2 (two) weeks may be granted to
the Department for doing the needful in the matter.
On the next date fixed, the learned counsel for the P&RD
Department shall have specific instructions with regard to the letter dated
13.07.2021 issued by the Office of the Commissioner, P&RD Department
which was addressed to the Accountant General, Assam.
The learned Standing counsel for the respondent no. 3 shall have
specific instructions on the issue of whether pension has been made
available to the petitioner pursuant to the aforesaid communication. If the
pension papers have in fact being forwarded to the Office of the
Accountant General, then there should be no reason as to why the
Mediation had ultimately fail.

List this matter again on 16.02.2026. Failure on the part of the
respondent authorities to provide adequate assistance to the Court
through the learned counsel appearing for the respondent may entail
personal appearance of the respondents.
The learned counsel appearing for the Accountant General, Assam
has later on appeared in the matter and submitted a communication dated
22.09.2025 which reflects the proceedings that had taken place before the
Mediation Centre and the reasons why the DCRG of the petitioner has not
yet been released.
A copy of the communication dated 22.09.2025 shall be kept on
record and marked with the letter ‘X’.
