ORDER

Date : 13-02-2026 Heard Ms. A Begum, learned counsel for the petitioner. Also heard Ms.

B Bhuyan, learned senior counsel as well as the learned Standing Counsel, BTC appearing for respondent Nos. 2 & 3 and Ms. U Das, learned counsel appearing for respondent No. 1.

[2.] Having considered the limited prayer made by the petitioner, the writ petition is taken up for disposal at this motion stage itself. It is the case of the petitioner that he has filed an application before the Secretary, Market and Fairs Department, BTC for issuance of a license to the petitioner for running a private cattle market on Schedule-A of the land mentioned in the said representation. The said representation was submitted through speed post on 26.09.2025 (Annexure-3). But the same having not been considered, the petitioner is before this Court.

[3.] The learned counsel for the petitioner submits that the limited prayer of the petitioner, at this stage is for directing the respondent authority concerned to consider the petitioner’s representation and dispose of the same in accordance with law.

[4.] Ms. B Bhuyan, learned Standing Counsel, BTC submits that Court may consider passing appropriate orders as may deem fit and proper.

[5.] Considering the above, the writ petition is disposed of with a direction to the respondent authority, more particularly, respondent No. 3 to consider and dispose of the representation submitted by the petitioner on 26.09.2025 in accordance with law, as expeditiously as possible, preferably within a period of 6 (six) weeks from the date of receipt of a certified copy of this order.

[6.] The petitioner shall also furnish a copy of the writ petition to respondent No. 3 along with a certified copy of this order for doing the needful. Thereafter, the order to be passed by the respondent No. 3 shall be communicated to the petitioner.
