ORDER
Date : 13.02.2026 Case taken up before the Lawazima Court.
Learned counsel Ms. M. Choudhury appears on behalf of the appellant. Heard.
Perused the records.
Perusal of the recent office note dated 18.12.2025 reveals that the notice was issued through dasti mode to the respondent No. 5 on 10.06.2024 and the same was received by the learned counsel on 12.06.2024.
However, as of today, the appellant has not filed any affidavit regarding service of the said dasti notice upon the respondent No. 5.
But, the learned counsel for the appellant, Ms. M. Choudhury has appeared before the Lawazima Court today and submitted that they have tried to serve the said dasti notice upon the respondent No. 5, but, as of today, the same could not be served. As such, the learned counsel has prayed for further 4 (four) weeks time as a final opportunity to effect the notice upon the respondent No. 5.
In view of the above, the appellant is afforded further more time to file the necessary affidavit reflecting the sevice status of dasti notice issued upon the respondent No. 5.
Let the matter be listed before the Lawazima Court again on 10.03.2026.
