Heard Mr. M. Hussain, the learned counsel appearing on behalf of the petitioners. Mr. N. Goswami, the learned Government Advocate appears on behalf of the respondent Nos. 2 to 5 and Ms. P.R. Phukan, the learned Standing Counsel appears on behalf of the respondent No. 1.
2. The grievance of the petitioners herein is that pursuant to the Award No. 250 passed in L.A. Case No. 02/2025-26 they had submitted application before the District Commissioner- cum-District Collector, Dhubri under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The case of the petitioners herein is that the said applications had not been considered and no reference had been made in the meantime and as such, the petitioners have approached this Court.
3. The instant writ petition was listed before this Court on 28.01.2026, wherein this Court sought for instructions from the Respondent Authorities, as to what, steps have been taken pursuant to the petitioners’ applications seeking reference to the Court for enhancement of compensation.
4. Today, when the matter is being taken up, a para wise comments have been placed before this Court by Mr. N. Goswami, the learned Government Advocate which is kept on record and marked with the letter “X”. From a perusal of the said, it appears that on 07.02.2026, the District Commissioner, Dhubri, has already forwarded the application filed by the petitioners to the learned District and Sessions Judge, Dhubri, so that a proceedings can be initiated for adjudication, as to whether, the petitioners are entitled to enhancement of the compensation.
5. Taking into account that the Respondent Authorities, more particularly, the District Commissioner, Dhubri have already acted upon the representation dated 31.10.2025 and have made a reference to the learned Court of the District and Sessions Judge, Dhubri, nothing further remains in the instant proceedings, for which, the instant proceedings stands closed.
6. The petitioners herein shall now take appropriate steps before the learned Court of the District and Sessions Judge, Dhubri.
