ORDER

20.02.2026 Heard Shri MU Mondal, learned counsel for the petitioners.

The grievance of the petitioners is against a notice dated 18.02.2026 issued by the Circle Officer, Bilasipara whereby demarcation of the boundary of a plot of land has been scheduled on 21.02.2026 and the parties including the petitioners have been directed to be present.

Amongst other grounds, it is contended that while the impugned order has referred a case being WP(C)/2699/2025 of this Court, there is,as such, no orders passed by this Court directing demarcation. The learned counsel has submitted that the petitioners herein arethe respondents in the said writ petition and by referring to the orders passed in the said writ petition which have been enclosed in this writ petition,he has reiterated that there is no such direction.

Let notice be issued, returnable on 13.03.2026.

Shri N. Bordoloi, learned Standing Counsel, Revenue Department accepts notice on behalf of the respondent no. 1 andShri N. Goswami, learned State Counsel accepts notice on behalf of the respondent nos. 2&3. Extra copies of the writ petition be served upon the learned counsel for the respondents by tomorrow. Petitioners to take steps for service of notice upon the respondent nos. 4 & 5 by speed post with A/D. Steps within two days.

Shri Mondal, learned counsel for the petitioners prays for an interim order.

While an exercise of demarcation per se cannot be treated as illegal, in the instant case it is seen that the impugned notice as referred to the WP(C)/2699/2025 and on perusal of the orders passed in the said case, no such direction is discernible.

In that view of the matter, till the returnable date, further proceeding pursuant to the notice dated 18.02.2026 shall remain suspended.

In the interest of justice, list this case on 13.03.2026 along with WP(C)/2699/2025.
