Date : 25.02.2026 Heard Mr. M. Sharma, learned counsel for the petitioner; Mr. M. Chetia, learned Junior Government Advocate, Assam for the respondent nos. 1, 3, 4, 5, 6 & 7; and Mr. M. Bhuyan, learned counsel appearing on behalf of Mr. B. Gogoi, learned Standing Counsel, Finance Department for the respondent no. 2.

2. As the learned counsel for the respondents have submitted that they have received the instructions necessary for disposal of the writ petition, notice is issued making it returnable forthwith.

3. The petitioner has stated that he is the owner and proprietor of M/s B.K. Traders, Goalpara and he is a registered contractor under the Assam Police Headquarters, Government of Assam vide Registration no. S/III-RC/GR-B/2019/VOL-I/62 [422] dated 19.02.2021.

4. The petitioner has stated that in the course of his business, he had supplied various items/articles to the Respondent no. 7, such as, stationary items, electrical items, computer items like – cartridge, Xerox toner, etc. on the basis of supply orders from time to time during the period from 2021 to 2023. After supplying the items/articles on the basis of the supply orders, he submitted the bills regularly by following the requisite formalities. The respondent no. 7 as the DDO had also issued genuineness certificates from time to time and the petitioner has annexed those genuineness certificates to the writ petition.

5. It is the further case of the petitioner that though as against the final bills the petitioner had received part-payments, the petitioner has not received the following amount till date :-

6. As despite elapse of sufficient period of time, the respondent authorities have not disbursed the afore-stated outstanding dues against the suply orders, the petitioner is before this Court seeking inter alia a direction to the respondent authorities to disburse the said amount forthwith.

7. Mr. Chetia, learned Junior Government Advocate, Assam has placed an Office Letter bearing Memo no. GLP/Acctt./2026/528 dated 21/02/2026 received by him from the respondent no. 7. As per the instructions received by him, the respondent no. 7 has admitted that the petitioner had supplied various items/articles, mentioned in the writ petition, and again such supplies of items/articles, certificates were also issued by the respondent no. 7. It is further mentioned that the bills submitted by the petitioner against the supply orders were duly sent to the competent authority for necessary sanction. Though the bills have been financially sanctioned but due to non-allocation of fund/ceiling, the amount could not be transferred to the petitioner.
