ORDER

Date : 25.02.2026 Heard Mr. A.J. Hazarika, learned counsel for the petitioner.

2. The learned counsel for the petitioner has referred to a common Judgment and Order dated 24.09.2025 rendered in a batch of writ petitions, W.P.[C] no. 3389/2025, W.P.[C] no. 237/2025 & W.P.[C] nо. 5157/2025. In W.P. [C] no. 237/2025, the respondents arrayed herein were the writ petitioners. In the Judgment and Order dated 24.09.2025, it was observed that the Principal Secretary to the Government of Assam, Panchayat and Rural Development Department would consider whether the application submitted by the petitioners therein, that is, the respondents herein on 22.08.2024 under Section 107 of the Assam Panchayat Act, 1994 seeking approval to run the private market can be granted approval or not and the same was directed to be considered within a period of thirty days. In an Order dated 19.09.2025 passed in Cont.Case [C] no. 394/2025, the District Commissioner, Goalpara was directed not to permit any cattle market on Friday at Gournagar Damribhasha Bridge Tiniali Pashuhat till the interim order passed in W.P.[C] no. 3389/2025 would be in operation. It is stated that the private cattle market, Gournagar Damribhasha Bridge Tiniali Pashuhat was being run by the respondents herein.

3. It is the case of the contempt petitioner that despite restriction on the respondents herein not to run the market named, Gournagar Damribhasha Bridge Tiniali Pashuhat, they have been running the market with impunity.

4. Issue notice, returnable on 25.03.2026.

5. The petitioner shall take steps for service of notice upon the respondents by speed post within 3 [three] working days from today.
