Heard Mr. A.M. Barbhuiya, learned counsel for the petitioner. Also heard Ms. S. Baruah, learned CGC; Ms. S. Kataky, learned standing counsel for the ECI; Mr. G. Sharma, learned standing counsel for the FT matters and NRC;
and Mr. P. Sarmah, learned Additional Senior Govt. Advocate for respondent.
2. By filing this writ petition under Article 226 of the Constitution of India, the petitioner has assailed the impugned opinion dated 29.01.2026, passed by the learned Member, Foreigners’ Tribunal, Jorhat, Assam, in Case No. FT/SVR/221/2012, arising out of Police Enquiry No. 125/12, by which the petitioner was declared to be a foreigner who has entered India (Assam) from the specified territory of Bangladesh during the period from 01.01.1966 to
24.03.1971 illegally.
3. Accordingly, the petitioner was directed to register his name as foreigner before the concerned Foreigners Regional Registering Authority under provision of rule 19 of the Citizenship Rules, 2009 within 20 (twenty)
days from the date of the order.
4. Issue notice returnable in 4 (four) weeks.
5. Requisite extra copies of the writ petition be furnished to the learned counsel for the respondents within 2 (two) working days.
6. Call for the records from the concerned learned Tribunal at following e-mail address of the learned Tribunal:-

7. In view of the nature of order passed, there is no requirement for the petitioner to take bail.
8. List the matter after 4 (four) weeks on receipt of records.
