Heard Mr. A.M. Barbhuiya, learned counsel for the petitioner.

2. By filing this writ petition, the petitioner prays for a direction to the respondent authorities to release the arrear salary for the period from

01.02.2007 to 29.02.2012 with interest.

3. It is the case of the petitioner that the petitioner was appointed as Manipuri Language Teacher at Baikuntha Roy M.E. School in the district of Cachar on 23.06.1991. On 08.02.2007, the service of the petitioner was terminated, however, in terms of the order of the Assam Administrative Tribunal, the petitioner was reinstated. Thereafter, he is receiving his salary since 2012. However, the respondents have failed to release the arrear salary from 01.02.2007 to 29.02.2012, during which the service of the petitioner was terminated. It is contended by the petitioner that although during the said period, the petitioner was not in service, however, in view of the observation made by the Assam Administrative Tribunal, the petitioner is entitled to the

arrear salary for the period from 01.02.2007 to 29.02.2012.

4. Issue notice to the respondents, returnable by four weeks.

5. Since Ms. S. Chutia, learned standing counsel, Elementary Education

Page No.# 3/3 Department; Mr. A. Chaliha, learned standing counsel, Finance Department; and Ms. N.M. Sarma, learned standing counsel, Secondary Education Department have entered appearance and accepted notice on behalf of the respondent Nos. 1 and 4; 2 and 5; and 3 respectively, no formal notice is required to be issued to the said respondents. However, extra copies of the petition be furnished to them

within three working days from today. 6. List the matter after four weeks.
