Heard Mr. S. Haque, learned counsel for the petitioner and Mr. I. Alam, learned Standing Counsel for the NCTE for respondent Nos. 1 and 2. Also heard Mr. I. Sheikh learned counsel, appearing on behalf of Mr. P.J. Phukan, learned Standing Counsel, Gauhati University for respondent No. 3.

By this application filed under Article 226 of the Constitution of India for a writ in the nature of Mandamus or Certiorari, the petitioner has challenged the impugned order dated 14.05.2025, issued by the Regional Director, Eastern Regional Committee, NCTE, by which recognition for the B.Ed Classes guaranteed to Dr. Sarvapalli Radhakrishna Teacher’s Training Research Institute (DSRTTRI), Chamata Nalbari was withdrawn. The prayer is also made by the petitioner that the Court may direct the respondents to cancel or recall the order dated 14.05.2025.
3. The case of the petitioners is that the college i.e. Dr. Sarvapalli Radhakrishna Teacher’s Training Research Institute (DSRTTRI) is a recognized college for conducting B. Ed Course for two years’ duration and the said permission was granted by the NCTE on an application made by the said college on 27.04.2017 and the said recognition was extended from time to time.

While the college was imparting the education, it is stated that a public notice was issued by the NCTE on 09.09.2024 by which it was intimated that the decision of the General Body of the NCTE that year-wise mandatory submission of Performance Appraisal Report (PAR) for the academic session 2021-2022 and 2020-2023 has to be made on the NCTE portal through online Portal and the last date for submission of the PAR i.e. Performance Appraisal report through online was 10.11.2024, which was further extended to 10.12.2024 and subsequently to 31.12.2024.

Pursuant to the said public notice, the Principal of the College had requested the President and Secretary of the Sponsoring Body seeking some documents for filling up the online PAR for the said Sessions. However, the same could not be submitted before the NCTE Authority due to some misunderstanding and when the last date for submission of the PAR was approaching, the Principal of the College requested the NCTE to grant 3 months’ time for submission of the PAR. Due to said non-submission, the Regional Director of NCTE issued a show cause notice to the college authorities on 27.03.2025 asking for an explanation as to why recognition under Section 17(1) of the NCTE Act, 1993 should not be withdrawn with a further direction to file the reply within a period of 15 days to which the college authorities is said to have submitted the reply.
6. In the said reply, the Governing Body of the College stated that due to lack of cooperation from the sponsoring body, the Principal could not submit the PAR within time.
7. Thereafter, the President of the Governing Body by a communication dated -09.05.2025 submitted the documents before the respondent authorities which were also forwarded to online portal. However
