Heard Mr. D Ullah, the learned counsel appearing on behalf of the petitioner.

2. Issue notice making it returnable on 29.05.2026.

3. Mr. I Borthakur, the learned Standing Counsel, Forest Department accepts

notice on behalf of the respondent Nos.1 to 4. Extra copies of the writ petition

be served upon him during the course of the day.

4. The case of the petitioner herein is that the petitioner wants to set up a

stone crusher unit and accordingly had submitted an application on 31.08.2024

along with all necessary documents.

5. It is the further case of the petitioner that due verifications have also been

conducted and the certificate from the Pollution Control Board has also been

submitted. Inspite of that the respondent authorities have not taken any steps

for issuance of license thereby affecting the rights of the petitioner to

operationalise the stone crusher unit.

6. The Forest Department, Govt. of Assam shall apprise this Court on the next

date fixed by way of instructions as to why the petitioner’s application has not

yet been processed.

7. This Court shall consider about filing of the affidavit on the next date upon

production of the instructions by the learned Standing Counsel of the Forest

Department.
