Case taken up before the Lawazima Court.
Learned counsel Mr. A. Ali appears on behalf of the petitioner. Heard.
Perused the records.
A perusal of the case record reveals that this matter was previously listed before the
Lawazima Court on 31.07.2025. On that date, it was observed that notices had been issued to
Respondent No. 1 by registered post with A/D and through the Officer-in-Charge, Naharkatia
Police Station.
However, in respect of the said notices, neither the A/D card, the unserved notice, nor
any service report was received by the Registry. Considering this, the Lawazima Court
directed the concerned section to issue a reminder to the Officer-in-Charge, Naharkatia Police
Station, requesting the service report of the notice issued to Respondent No. 1.
In accordance to the said order, it appears that the concerned section issued a reminder
to the appropriate authority on 27.08.2025.
However, despite the said reminder, it appears that the service report of the notice
issued to the respondent No. 1 has still not been received by the Registry. Consequently, this
Lawazima Court is unable to ascertain the service status of the notice issued upon the
respondent No. 1.
In view of the circumstances mentioned above, this Lawazima Court is of the view that
fresh steps should be taken by the petitioner for effective service of notice upon the

respondent No. 1. As such, the petitioner is hereby directed to take fresh steps for service of
notice upon the respondent No. 1 by way of speed post [in terms of the Notification No.
85 dated 15th October, 2025 (at Flag-‘N’)] and by way of usual process mode
[in terms of the Hon’ble Court’s order dated 08.05.2023]
Let the matter be listed before the Lawazima Court again on 15.06.2026.
